1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Business Soluter, operating as Backlinks.tools ("Company", "we", "us", or "our"), governing your access to and use of the Backlinks.tools platform, including all associated software, APIs, features, and content (collectively, the "Service").

By creating an account, clicking "I agree", or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Description of Service

Backlinks.tools is a SaaS-based digital marketing platform that provides:

• SEO Analytics: Backlink monitoring, rank tracking, domain authority analysis, and website audit tools
• Social Media Management: Instagram post scheduling and publishing, analytics dashboards, and comment moderation tools
• Reporting: Automated reports, data exports, and performance insights

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. User Accounts

3.1 Registration

To access the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the accuracy of this information and updating it as necessary.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately at [email protected] if you suspect any unauthorized access to your account.
• You may not share your account with or transfer it to any other person.

3.3 One Account Per User

You may only create one account per person or legal entity. Creating multiple accounts to circumvent usage limits, subscription restrictions, or account bans is strictly prohibited.

4. Subscriptions & Billing

4.1 Subscription Plans

The Service is offered under several paid subscription tiers (Free, Pro, Max, Ultra). Features available to you depend on your active plan. We reserve the right to modify plan features and pricing with reasonable advance notice.

4.2 Payment

• Subscriptions are billed on a recurring monthly or annual basis, depending on the plan selected.
• Payment is due at the beginning of each billing period.
• All prices are in USD unless otherwise stated.
• Payments are processed securely by our third-party payment provider (Razorpay).

4.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. By subscribing, you authorize us to charge your payment method for renewal fees.

4.4 Refunds

Our refund policy is governed by our Cancellations & Refunds Policy, which includes a 14-day money-back guarantee for first-time subscribers.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You may not use the Service to:

• Violate any applicable local, national, or international law or regulation
• Infringe any third party's intellectual property, privacy, or other rights
• Transmit any unsolicited or unauthorized advertising, spam, or promotional material
• Scrape, crawl, or extract data from the Service using automated means without prior written consent
• Attempt to gain unauthorized access to any part of the Service, or any connected system or network
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to post, schedule, or publish content that is defamatory, obscene, hateful, or otherwise objectionable
• Impersonate any person, company, or entity
• Circumvent any usage limits, rate limits, or security mechanisms of the platform
• Engage in any activity that disproportionately burdens or disrupts the infrastructure of the Service

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

6. Third-Party Integrations

6.1 Meta / Instagram Integration

Our platform integrates with the Meta Graph API to provide Instagram management features. Your use of this integration is subject to:

• Meta's Community Standards and Developer Policies

You are solely responsible for ensuring that any content you schedule or publish through our platform complies with Instagram's Community Guidelines and all applicable laws. We are not responsible for any actions taken by Meta against your Instagram account, including account suspension or content removal.

6.2 Google Services

Features such as rank tracking and site audit may interact with Google services. Your use of these features is subject to Google's Terms of Service.

6.3 Third-Party API Changes

We rely on third-party APIs (Meta, Google, etc.) to provide core functionality. If these APIs change, are restricted, or become unavailable, some features may be temporarily or permanently affected. We are not liable for disruptions caused by changes to third-party APIs.

7. Intellectual Property

7.1 Our Property

The Service, including all software, algorithms, user interface designs, databases, text, graphics, logos, and other content, is the exclusive property of the Company and its licensors, protected under copyright, trademark, and other applicable laws.

7.2 Your Content

You retain full ownership of any content you create, upload, or schedule through the Service (captions, images, videos, etc.). By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and transmit your content solely for the purpose of operating and delivering the Service to you.

7.3 Feedback

If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us a non-exclusive, perpetual, irrevocable, royalty-free right to use and incorporate such feedback in any way without compensation to you.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy and Data Policy, both of which are incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in those policies.

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion option in your account settings. Termination takes effect at the end of your current billing period.

9.2 Termination by Us

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you:

• Breach any provision of these Terms
• Violate our Acceptable Use Policy
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees when due

9.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. We will retain your data for up to 90 days post-termination, after which it will be permanently deleted. Refer to our Data Policy for full details.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim arising from the Service shall not exceed the total fees paid by you to us in the three (3) months preceding the claim.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Material changes will be communicated to you via email or a prominent notice on our platform at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
